Pan Atlantic v Pine Top And The Star Sea

Most notably, the Pan Atlantic v Pine Top ruling by the House of Lords changed the law by holding that, in order to rely on the remedy of avoidance, it was necessary to prove that the underwriter had been induced to enter into the contract. We acted for the cedant advocating that change.

Subsequently, in Manifest Shipping Co v Uni-Polaris Insurance Co ("The Star Sea"), we were representing insurers when the Lords considered, for the first time in over 50 years, the duty of good faith in the context of claims presentation under a marine policy.
