Airline start-ups

Our lawyers have significant experience in advising on all the issues concerning airline start-ups. Senior members of our team include Chris Walsh who helped set up, among others, Emirates. 

In any airline start-up there will be regulatory requirements, even regulatory barriers, which must be considered at an early stage.  For example, apart from need to apply for operating licences, traffic rights may or may not be available, external investment may require consideration of any restrictions on the nationality of ownership and control of air carriers, and there may be choices to be made in terms of state of registration of aircraft.

In particular complex corporate financing structures often give rise to issues of nationality of ownership and control. Our lawyers have advised on many such structures and are able, usually quickly, to advise whether a proposed structure is likely to be compliant and, if not, how to restructure it.  Our lawyers have significant experience of advising promoters and investors in airline start-ups on the full range of regulatory issues. We also advise on the legal remedies available when new start-ups encounter  anti-competitive behaviour from competing  airlines.
   
Our lawyers have particular experience of advising on or in respect of the start-up of low cost carriers, such as easyJet, Wizz Air, and Zoom.  

Our familiarity with aircraft and engine manufacturers such as Boeing, Airbus Bombardier, and Rolls Royce, and with operating lessors and financiers, along with their forms of contract and policies help clients to acquire and finance aircraft and equipment on the best possible terms.

We advise new airlines on their agreements with airports (including incentive based agreements and issues of state aid where these arise), ground handling arrangements and have a particular knowledge of airport slot regulation and airport slot agreements.
  
As well as our specialist aviation knowledge of regulatory and competition issues and aviation leasing  and finance, we have the core capabilities to advise on commercial agreements, employment law, intellectual property law, insurance, real estate, corporate law and insolvency issues .
