Regulatory, commercial & corporate

Our commercial aviation team brings a strong commercial sense with a sound understanding of air transport and travel industry regulation in their economic and aero-political context.

Our lawyers have many years of experience of advising airlines, airports, financial institutions, investors, governments and regulators, on all aspects of international air transport and air travel regulation.

We advise on air transport licensing, the economic regulation of airports and suppliers, such as ground handlers, and all forms of contractual arrangements arising in the aviation industry including conditions of carriage, aircraft leases and charters, airport services, airport slots, ground handling, maintenance and repair contracts, franchising, code sharing, outsourcing, computer reservations, and distribution.
Ince & Co’s team is ‘thorough, prompt and knowledgeable,’ and ‘offers good value for money.’  Legal 500
Our lawyers have substantial experience of advising on consumer protection including the law on unfair terms in consumer contracts, advertising standards, passengers rights in respect of denied boarding, delay and cancellation, air travel organisers licensing and package tour and holiday regulation.

We can advise you on company law and corporate governance. We act for vendors and purchasers of companies and businesses and undertake due diligence (with the advantage of our understanding of air transport regulation and licensing, and industry commercial contracts and competition and merger regulation).

An important part of our regulatory practice is advising on competition law at national and EU level. We have experience over many years of advising on the prohibition of anti-competitive agreements and practices, unlawful state aid, abuse of dominant position and on merger regulation. Our lawyers have taken such cases before the competition authorities and the courts, have handled applications for exemptions and have filed notifications and submissions in investigations into airline mergers and alliances.

We deliberately avoid a “silo” approach to the provision of legal services across our areas of expertise. Instead, our lawyers are recognised and appreciated for working seamlessly in teams and when using the resources of our various international offices, to the benefit of clients.

We deal regularly with government officials and regulators including the UK Civil Aviation Authority, the US Federal Aviation Administration and the European Commission. Our lawyers have also appeared as advocates before a variety of courts and tribunals, and at hearings in competition and merger cases, before the UK competition authorities and the European Commission. We also support our clients at both formal and informal meetings with regulators, government ministers and officials, and at appearances before inquiries and before parliamentary select committees.
