Insolvency and corporate recovery

Ince & Co’s team of lawyers provide insolvency advice to corporates and individuals.

Financial distress can have far reaching implications for corporate and individuals alike and, in the current economic climate, stakeholders are looking at ways to reduce costs through the use of various corporate or financial restructuring tools.  We work with businesses in financial difficulties across a range of sectors with the view to rescuing such businesses, mitigating risk and maximising recoveries.

We act on both contentious and non-contentious matters for a variety of stakeholders which include debtors, funders and other creditors, insolvency practitioners, directors and parties interested in acquiring distressed assets or debt.  The expertise and in depth sector knowledge of our lawyers enable us to provide innovative and pragmatic advice to assist our clients through the most difficult of situations.

Due to the international nature of our client base, we advise on cross border insolvency issues under the EC Regulation on Insolvency Proceedings 2000 and the Cross-Border Insolvency Regulations 2006 and can draw on local jurisdiction expertise through our global network of offices and international relationships.

We regularly advise on the following:

  • administrations
  • receiverships
  • company and individual voluntary arrangements
  • compulsory and voluntary liquidations
  • directors’ liabilities and responsibilities, including misfeasance and wrongful trading
  • recovery of assets
  • schemes of arrangement under the Companies Act
  • set-off and counter-claims in insolvency bankruptcies
