Brian is a specialist disputes lawyer and partner in the firm’s insurance, trade and transportation practices.

He joined the firm in 2000, moving to Ince Dubai in 2006, and became a partner in 2010. 

Insurance

Brian specialises in insurance disputes and his insurance practice includes advising on issues arising under marine/yacht, property, liability, energy, trade credit & political risks and financial lines insurances. 

Brian advises on claims arising under direct insurance policies as well as claims under facultative and treaty reinsurance policies. He has acted in several insurance disputes in arbitration, before the English High Court and is regularly involved for insurers, in the local courts in the Middle East, in coverage claims, defence work and in pursuing/defending, subrogation claims.

Transportation

As transportation, Brian advises owners, charterers, cargo interests, ship managers and liner operators on disputes arising under charterparties, bills of lading and other contracts of carriage. His work includes both front-end advice on contract wordings and contentious matters including ship arrest, collisions and groundings.

Brian has had secondments with a major international airline and private jet operator, both in the Middle East. His aviation and shipping practice includes advising on discrete general aviation and shipping issues as well as dealing with the insurance issues which arise from them. Brian acted in a major claim for contingency underwriters relating to the disappearance of two aircraft on wet lease in the Middle East.

Compliance

Brian advises on matters of regulatory compliance in the area of international sanctions and compliance regimes and also has extensive experience advising clients on matters relating to GDPR, cyber security, incident response, statutory reporting etc. He advised clients on legal issues in the field of cyber and the impact on insurance cover as well as on policies and potential compliance issues in preparation for the implementation of GDPR. Brian also advises on discrete areas of the UAE’s application of VAT.

Brian has wide ranging experience of commercial litigation both in the English High Court and the local courts in the Middle East. His practice includes acting in international arbitration (including LCIA, LMAA, DIAC, and ad hoc arbitration references) and alternative dispute resolution, particularly mediation.

Recent case examples

Highlights of Brian’s most recent cases include:  

>  Acting for ship owners and their fixed and floating objects insurers in a landmark decision before the Dubai World Tribunal establishing the ability for ship owners and their liability insurers to limit their liability under UAE law, and to do so in the form of a P&I Club Letter of Undertaking pursuant to 1976 limits of the Limitation of Liability Convention for Maritime Claims.

>  Acting for successful insurers in defending claim under a Builder’s Risks policy before the UAE local courts in a dispute as to the nature of the indemnity available was an agreed value policy or a limit of liability dependent on the actual value of loss.

>  Advising reinsurers on coverage issues arising under an operational material damage and business interruption policy following a mechanical failure of equipment at an onshore energy plant causing high value losses.

>  Acting for property and business interruption insurers in multimillion dollar subrogation claim against ship owners and their P&I Club following damage to the insurer’s port facility.

>  Acting for property and business interruption insurers and the insured following a fire at major shopping mall in the Middle East.
