Nicholas is a litigator who focuses on complex commercial disputes, dry shipping, shipbuilding, and international trade and commodities matters.

Qualified in Australia and Hong Kong, Nicholas primarily represents both Western and Chinese parties in maritime and trade-related cases before the Hong Kong courts and international arbitrations. Many matters involve oversight of, or co-ordination with, foreign proceedings. His experience encompasses various issues related to bills of lading, charterparties, contracts of affreightment, shipbuilding contracts, ship sale and purchase contracts, and large commercial agreements. He has a particular interest in assisting companies and creditors alike to navigate the consequences of financial distress and insolvency.

Aside from contentious work, Nicholas has also advised clients in the drafting and negotiation of bespoke contracts, the implementation of regulatory compliance policies for international business, and defence of regulatory investigations. Nicholas regularly leads in-house training seminars and gives presentations to industry associations and large multinational companies on issues pertaining to trade sanctions and regulatory compliance. 

He is also a contributing author to Atkin’s Court Forms: Hong Kong; Aircraft Finance: Regulation, Security and Enforcement; and has also been published in the European Procurement & PPP Law Review.

Highlight matters

>  Acted for a large Chinese state-owned shipyard in advancing its US$14 million claim under shipbuilding guarantees in London arbitration and ancillary Hong Kong proceedings to successfully obtain an interim worldwide Mareva injunction

>  Advised numerous European and Chinese banks on the enforcement of mortgages against movable assets, including the co-ordination of multi-jurisdictional enforcement action to arrest and sell vessels worldwide, including successful recoveries in ‘difficult to enforce’ jurisdictions such as Bangladesh and China.

>  Acted for an aggrieved investor in multi-jurisdictional litigation and regulatory action against an international investment management group for  financial misrepresentation and mis-selling of investment products, resulting in successful recovery of the investor’s funds

>  Advised a world-leading automotive franchise in the drafting and successful conclusion of a bespoke contract of affreightment to import high-value luxury cars into Hong Kong and Macao

>  Represented one of the world’s largest banks in its successful defence of a regulatory investigation instituted by the Hong Kong Monetary Authority
